THE PEOPLE MOURNED BECAUSE TO THEM THE MAHARAJH LAILA SUCCESSOR TO MAHARAJAH ADINDA DATU ALIUDDIN KIRAM IS MUCH MORE THAN A FATHER TO THEM WHO NURTURED THEM FOR LONG YEARS.

An Interview with HRH Sultan Esmail D. Kiram II

BV : Your Highness , It is highnoon that after so many years of your silence, the Sultanate of Sulu and North Borneo is well and alive as per successive media exposure of your Traditional Kingdom. What is your plan ?
EDK: Well , since all fake sultans are now back in the bin for extinction , it is my plan to implement the long delayed implementation of the 1939 High Court of North Borneo Ruling.
BV: Your Highness , What is that 1939 High Court of North Borneo Ruling ?
EDK: The 1939 High Court of North Borneo Ruling is the final and executory decission officiated by Judge McKaskie in 1939. This is comprising of two separate ruling , the first is the monetary award given by the High Court given to nine principal heirs to the rental money of Sabah. Second is the awarding of the " LETTER OF ADMINISTRATION " to my father , Punjungan Kiram over Sabah. The resumption of rental fee was implemented but the " Letter of Administration " over sabah was not implemented due to 2nd world war and the chaos of SSNBK leadership after the war.
BV: Your Highness, you mentioned the leadership chaos of SSNBK. What exactly the reason of this chaos ? Is it internal to the family or externally induced ?
EDK: Very good question. Actually there is two facet, first is the protest of the rest of Kiram clan why the Letter of Sabah Administration was given by judge Mckaslie to my then Rajah Mudah father and not to his brother Sultan Esmail Kiram I . A close examination of McKaskie Judgement will reveal that my father was technically acknowledged as the heir of Sabah by way of giving weight to the matrimonial and conjugal relationship of my grandfather Sultan Mawalil Wasit to Mora Napsa my grandmother. The British High Court made it carefully as such because Britain is exercising a Christian teaching and not Muslim. Britain exercises monogamy and therefore they chose one among the wives of my grandfather , a Muslim to Mora Napsa my grandmother. This can be seen clearly that among the wives of my grandfather - only my grandmother, Mora Napsa was included as one of the nine principal heirs to the monetary rental of Sabah based on 1878 lease agreement. This is now is being contested by the Kiram clan but judge Mckaskie knows by heart that he need to choose among the many Kirams, who will represent Sabah ownership under the British law , this propmpted him to choose my father then the Rajah Muda of Sultan Esmail Kiram I, Punjungan Kiram.
Second is the political motivation, business and personal venture of the Kirams to avoid the exercise of 1939 McKaskie Ruling. Claimant Sultans has sprouted like mushrooms in the hope that they can push themselves to the" Unbroken Process of Succession . Even the none Kirams like Omra Amilbangsa , the husband of Dayang Dayang Hadji Piandao, Rodinood Julaspi , and the sons of Sultan Esmail Kiram I join the wagon. They thought that judge McKaskie is motivated to decide to cause all Kiram in chaos. There is even deeper theory that by politically motivated paying the fake Sultan to create some chaos to Kiram clan is in place.
BV : Your Highness , Is it possible or will Malaysia allow you to 'Administer Sabah " since it is under their Federal Government?
EDK : Looking on the legal point of view , you cannot find Malaysia as a party to the 1878 lease agreement and yet they continue to pay the yearly lease. The main reason we accept the yearly lease from Malaysia is not because we accept them as a "Lessee " but to fortify that McKaskie Ruling has taken place in effect and they only continue from the British as representative . Sabah is actually not part of Peninsular Malaysia per se according the to 1963 "20 point Agreement " but a " Partner to Malaysia " prior to join Malaysia. This is very clear according to former Sabah Chief Minister Yong Teck Lee that there is a big differrence in Joining as a Partner and joining as part of the Peninsular Malaysia. The earlier leaders of Sabah has now repenting and realized the purpose of Peninsular Malaysia by politically deviating to the 20 point agreement by infusing a Federal backed Sabah party leaders to change the Sabah Constitution that will void the 20 point agreement . Peninsular Malaysia leadership in KL want to make it appear that Sabah is under the Constitution of Federal Malaysia. Sabah has it's own Constitution per se and therefore this clarify the issue as a partner not actually a state under Peninsular Malaysia.
BV: Your Highness , who will decide of the finality of the Sabah issues?
EDK : With regards to the Sabah political administration , the State officials at present is in the best position to decide under my Traditional leadership . I do not want to pre-empt the current political issue between Peninsular Malaysia and Sabah State officials , because it was already stated in 20 point agreement.
BV: Your Highness , How about the Philippine claim?
EDK : With respect to Philippine claim of Sabah has no basis at all because Sabah belongs to the Sultanate of Sulu per se through my father being the declared heir and administrator of North Borneo and not to the Philippine government. The temporary authority given to Phuilippine government to claim Sabah in behalf of SSNBK was long time revokated.
BV; Your Highness, If you had now in control of Sabah , to whose government you will allow Sabah to be under?
EDK:If you mean political governance, Malaysia has demonstrated an effective political administration as was decided by ICJ in Sipadan Ligitan case , it states that- Neither Indonesia nor Malaysia has proven the ownership of the contested area but as far as effective administration , Malaysia has proven by taking care of the habitation of the turtles and other marine life in the area. In short ICJ has favored Malaysia by "Virtue of Effectivites " but not ownership. However, it is not for me to decide as to whose government Sabah will be under . It is the people who will decide . My role is the Traditional and Cultural aspects of my people to preserve and not political.
BV; Your Highness , if Sultanate of Sulu and North Borneo own Sabah and the Center of your Kingdom is Sulu island , would it not be complicated that your kingdom is under the two political governments ?
EDK : SSNBK is very unique, it is the only Traditional and Cultural kingdom in the world that has two political government. This could be the reason of chaos in Mindanao and the delay of Sabah return because both country has primeval political interest on their own . SSNBK as of now is being technically sandwiched and under pressured by both political country.
BV: I see that you have no political agenda , How then you could exercise your leadership to the people of sabah and the people of Sulu ?
EDK : Like the rest of Eclessiastical governance , SSNBK can exercise the same not only to the Philippines and Malaysia but anywhere in the world. The subject governments has nothing to fear since SSNBK is not a political entity.
BV: Your Highness , could it be possible to help the stateless people in Sabah under your leadership?
EDK : This is one of my primary goal ,almost half million people of Sabah do not want to be acknowledge by Malaysia and now stateless . I want to help this people personally so I might decide to stay in Sabah for long to investigate the matter and come up with solution.
BV: Your Highness , that was very touching . What about the people of Mindanao? How can you help them ?
EDK : The people of Mindanao is highly politicized and therefore complicated, my limited power can only exposed those who is maybe behind it ,the ongoing war and kidnapping must have been a work of political in nature. The 33 years war in Mindanao is said to be sponsored by political powers and the solution to stop it must be carefully plan. Mindanao is impoverished and there is no way that secessionist can fight over the well supplied and well funded government against if no other big party is involved. United Nation must get involved in this 33 years onslaught of my people. I vowed to continue my" Peace Advocacy" to both Mindanao and Sabah to echo in the whole world.
BV: Your Highness , time is short and I hope we had tackled the most important issues. Revokation of Mohammad Fuad as Regent Sultan
It was very surprising that Datu M. Fuad Kiram I has been revokated as Sultan by Datu Muedzul Lail Kiram. ,his nephew son of Datu Mahakuttah Kiram . According to the revokation letter, both Datu Mohammad Fuad and Omar deux de Legaspi was appointed by Datu Muedzul Lail . This further complicate their story, Datu Muedzul Lail is the son of Datu Mahakuttah Kiram, ( son of Sultan Esmail Kiram I whom after his death) proclaimed by President Marcos under his political tenure, this was being in question if the political president can elect a Sultan for Sulu and Sabah since pres. Marcos is not an Islam and definitely not a Muslim under the Islamic Sultanate of Sulu and North Borneo kingdom. This error was realized by president Marcos when Rajah Mudah Punjungan Kiram arrived from Sabah and showed the " Letter of Sabah Administration" from the High Court of North Borneo to president Marcos. It appears that there is a treason betwen the nephew and his uncle committed by Datu M. Fuad because Datu Muedzul Lail was said appointed his uncle as Sultan of Sabah provided that Datu Muedzul Lail be the Sultan of Sulu , Datu M. Fuad instead took all the title by himself and to his son leaving Datu Muedzul Lail with no title.

DATU MUEDZUL LAIL KIRAM HAS EXPOSED HIS UNCLE MOHAMMAD FUAD I AS FAKE SULTAN OF SSNBK
Datu Mohammad Fuad I was finally exposed by his own niece, Datu Muedzul Lail who appiointed him as the Regent Sultan of Sabah has revoked his appointment . This further exposes the " Fake Claim " of Mohammad Fuad I, according to Datu Muedzul Lail , he has revokated the appointment of his uncle for series of serious violation of their truce. IT WAS SAID THAT DATU MUEDZUL LAIL AND MOHAMMAD FUAD I HAVE AN AGREEMENT PRIOR TO THE APPOINTMENT OF MOHAMMAD FUAD I TO STAND AS THE SULTAN OF SABAH ONLY BUT MOHAMMAD FUAD BREAK THEIR AGREEMENT BY INCLUDING SULU .

The coming exercise of the Sultanate of Sulu and North Borneo under the appointed Hongkong Company has finally drafted the final position papers to be submitted to the UN member state sponsor country. Since ICJ is only accepting cases in behalf of the member state of the UN. The issue regarding the matter of Sabah proprietary ownership. Malaysia thought all the while that by dragging the issue politically will intimidate the Leadership of the Royal Sultanate of Sulu and North Borneo Kingdom. Spain sold the Philippines to America for USD$20 million dollars , the impression that America has own the whole Philippines territorial land is actually wrong ,the reality was America bought the political administration only not the territorial land , that includes Visayas and Luzon as Spanish term 'Las Islas Filipinas', not including Mindanao because the Spanish never conquer the Sultanate Kingdom to become part of the spoil of war under the Treaty of Paris. LORD EARL GRANVILLE TESTIMONY: SABAH IS SOVEREIGN OWNERSHIP OF SSNBK
Lord Earl Granville, the Foreign Minister of the British Crown, manifested in his Letter to the Foreign Minister of Madrid. Evidence to this was the official correspondence of Lord Earl Granville, British Foreign Minister at the time, in his letter to the British Minister in Madrid dated January 7, 1882 explaining the character of the Charter Grant of the British North Borneo Company, as follows:
“The British Charter, therefore, differs essentially from the previous Charters granted by the Crown to the East India company, the Hudson’s Bay Company, the New Zealand Company, and other Associations of that character in the fact that the Crown in the present case assumes no dominion or sovereignty over the territories occupied by the company, nor does it purport to grant to the Company any powers of government there over; it merely confer upon the persons associated the status and incidents of a body corporate, and recognizes the grants of territory and the powers of government made and delegated by the sultan in whom the sovereignty remains vested… As regards the general feature of the undertaking, it is to be observed that the territories granted to the Company have been for generations under the government of the Sultan of Sulu and Brunei, with whom Great Britain has had Treaties of Peace and Commerce…
The above letter was done by the British Foreign Minister to explain and respond to the Spanish protest regarding the grant of Royal Charter to the British North Borneo Company. It was not the Spanish crown who made the protest alone; also the Dutch government protested the same. Again, Lord Granville maintains, in his letter to the Dutch, that the British North Borneo Company was a mere administrator, and that “British Government assumed no sovereign rights whatever in Borneo.�

Factual Background:
North Borneo is the original name of Sabah. Malaysia changed it to Sabah to probably elude the issue of the original name. Sabah is originally part of Brunei. Brunei has given Sabah Island to the Sultan of Sulu in aid to quell the war with Indonesia. The British rule Peninsular Malaysia. The Private British Company rented Sabah in 1878 . The Private British Company has transferred the Lease to British Government upon dissolution. In 1939, the High Court of North Borneo has ruled that Sabah belongs to the Sultanate of Sulu Kiingdom and a “Letter of Administration was given to Datu Punjungan Kiram, the son of Sultan Mawalil Wasit, authorizing to audit and to inventory all the proprietary properties of Sabah. The high Court of North Borneo stipulates the nine principal heirs to share the monetary rental of Sabah. Malaysia become independent in 1963 and absorbed Sabah and continue the rental payment of 5,000 ringgit. Malaysia changes the name of North Borneo to Sabah later and presently arguing that it was sold as to whom is not clear. Subsequently, Malaysia claims the island due to the decision of Cobbold Comission. One purpose of the case study is to find out if Malaysia is the legal entity to keep Sabah or the heir to the Sultanate of Sulu kingdom.
Legal Status:
The British Government absorbed Sabah from the Private British Company and has interpreted the word “ Padjak” under the term “ Cession", which was interpreted in the Malay language as “Rent” or “Lease ”. This was clarified in 1939 by the High Court of North Borneo by appointing Datu Punjungan Kiram as an “Administrator “ through the “Letter of Administration” . The High Court of North Borneo consequently appointed Nine “Principal Heirs” to share the monetary rental. In 1963, the British Government gave independence to Malaysia. Malaysia also absorbed Sabah giving the argument that it is part of Malaysia per se and continues to pay the yearly rental to the heirs of the Royal Sultanate of Sulu and North Borneo.
Legal Argument:
Sabah did not acquire by the British Empire by war. It was owned by the Royal Sultanate of Sulu Kingdom. It was contractually leased to a private British Company. Now, the 'Leased Contract of 1878" has a very clear stipulations clause that in no way it can be transferred to another company or country. The contract says it will take effect until the end of time. It does not matter if it is now, 2010. The contract is effective till today. The "TRANSFER" to the British Government is outright “ILLEGAL". The "TRANSFER" to Malaysia, when they got their independence, is also "ILLEGAL". This is double jeopardy in the rule of Law. How Malaysia can reason to the whole world as such and manipulate Sabah as if that is their own? They were even reminded many times by America and Britain upon realizing when they return Turtle Islands that Sabah belongs to the Royal Sultanate of Sulu Kingdom and hence it was called Royal Sultanate of Sulu and North Borneo Kingdom. It is not an empty claim; there are legal documents of 'Lease Contract'. There is a ‘Letter of Administration from the High Court of North Borneo’. No Court in the world will allow anybody to administer a piece of private land that was owned by someone of whom that does not belong to the person that administer, the chance is he is the owner of the land; unless, the appointment body is a government itself who owns the land and chooses someone. Factual Background:
North Borneo is the original name of Sabah. Malaysia changed it to Sabah to probably elude the issue of the original name. Sabah is originally part of Brunei. Brunei has given Sabah Island to the Sultan of Sulu in aid to quell the war with Indonesia. The British rule Peninsular Malaysia. The Private British Company rented Sabah in 1878 . The Private British Company has transferred the Lease to British Government upon dissolution. In 1939, the High Court of North Borneo has ruled that Sabah belongs to the Sultanate of Sulu Kiingdom and a “Letter of Administration was given to Datu Punjungan Kiram, the son of Sultan Mawalil Wasit, authorizing to audit and to inventory all the proprietary properties of Sabah. The high Court of North Borneo stipulates the nine principal heirs to share the monetary rental of Sabah. Malaysia become independent in 1963 and absorbed Sabah and continue the rental payment of 5,000 ringgit. Malaysia changes the name of North Borneo to Sabah later and presently arguing that it was sold as to whom is not clear. Subsequently, Malaysia claims the island due to the decision of Cobbold Comission. One purpose of the case study is to find out if Malaysia is the legal entity to keep Sabah or the heir to the Sultanate of Sulu kingdom.
Legal Status:
The British Government absorbed Sabah from the Private British Company and has interpreted the word “ Padjak” under the term “ Cession", which was interpreted in the Malay language as “Rent” or “Lease ”. This was clarified in 1939 by the High Court of North Borneo by appointing Datu Punjungan Kiram as an “Administrator “ through the “Letter of Administration” . The High Court of North Borneo consequently appointed Nine “Principal Heirs” to share the monetary rental. In 1963, the British Government gave independence to Malaysia. Malaysia also absorbed Sabah giving the argument that it is part of Malaysia per se and continues to pay the yearly rental to the heirs of the Royal Sultanate of Sulu and North Borneo.
Legal Argument:
Sabah did not acquire by the British Empire by war. It was owned by the Royal Sultanate of Sulu Kingdom. It was contractually leased to a private British Company. Now, the 'Leased Contract of 1878" has a very clear stipulations clause that in no way it can be transferred to another company or country. The contract says it will take effect until the end of time. It does not matter if it is now, 2010. The contract is effective till today. The "TRANSFER" to the British Government is outright “ILLEGAL". The "TRANSFER" to Malaysia, when they got their independence, is also "ILLEGAL". This is double jeopardy in the rule of Law. How Malaysia can reason to the whole world as such and manipulate Sabah as if that is their own? They were even reminded many times by America and Britain upon realizing when they return Turtle Islands that Sabah belongs to the Royal Sultanate of Sulu Kingdom and hence it was called Royal Sultanate of Sulu and North Borneo Kingdom. It is not an empty claim; there are legal documents of 'Lease Contract'. There is a ‘Letter of Administration from the High Court of North Borneo’. No Court in the world will allow anybody to administer a piece of private land that was owned by someone of whom that does not belong to the person that administer, the chance is he is the owner of the land; unless, the appointment body is a government itself who owns the land and chooses someone. Royal Sultanate of Sulu and North Borneo is now a politically diminished Kingdom. Politically, the control now is being held by those who are now holding the resources and properties of the Kingdom. Philippines and Malaysia are the two countries who were practically sitting to these majority of properties and resources of the Royal Sultanate of Sulu and North Borneo kingdom. The kingdom leadership is well and alive after so many years of tribulations that have now undergone by the hierarchy to the throne, even how hard they tried to bury the traditional leadership, they failed and just can not bury the kingdom because culture, history, traditions is a wittness and the identity of the people will exist forever, as long as the Malay Race exists. The first class perpetrators to the kingdom are Spain and America, the Philippines and Malaysia followed their suit, the fear of the renaissance of the kingdom to stand as a political power is the 'GHOST' that haunts these two countries. It is imperative that these two countries under their own political system has to 'SELF PROTECT ' their interests by keeping the Sultanate dirt, poor and beg for food to them. Malaysia is even worst in purging the very people that own the island, considering they are paying the rent, who was illegally absorbed from the British goverment that was also illegally absorbed from the original private company , who rented the island way back in 1878 . The current situation of the Philippines is somewhat very alarming for the fact that the erosion of civil society is continually eating the moral fiber of the people. The current political governance has lost the digestion to make the whole nation function properly; the whole body is being the victim of malnutrition by the people who run the governance. The rampant corruption of the people of starvation. Justice is one sided to the knowledgeable to the law and the powerful. Economy favors the powerful and the affluent few people but left the common citizen living in dire poverty. The true Filipino’s are like rats living in the manhole and under the bridges so very destitute that instead of becoming the pride of his country becomes the maggots that eats the spoiled and left over foods of ruling class and the elites.
What Went Wrong?
Knowing the situation must come to credible questions what went wrong in this country. By careful analysis and investigations, we will find out that from the very beginning of our inceptions as a country is all wrong. The history that was feed to us is all fake, written by the foreign colonizers that forcefully make us believe that the written history of our country is the valid one to cling and believed. Being under the Spaniards for 300 hundred years, all the traces of our original culture was almost erased coupled by the introduction of the western culture that is now eating our society.
By the Grace of God the truth is now unearthed, our original culture that was buried and to the expectations of our colonizers to be dead has sprung like a light at the end of the tunnel, hoping to cure the cancer that eats our current society. This development will finally pave way to raised our sanity to national level of patriotic Filipino not colonial.

The inherent arrogant attitude of the Spanish, the inherent easy-go-lucky lifelstyle of the Americans and the inherent business-attitude of the Chinese makes and comprise the Pilipino images today but in negative proportion instead of positive. Appointing our current political leaders in tandem with traditional titles will bring back our lost glory as a kingdom and will raise the nationalism and patriotic ideals of this country. The prestige of our people being noble from the beginning will bounce back to life embrace our original culture and set aside the artificial and borrowed culture. Making our people and country embrace a single culture people will align our ideals in to one country and one people road to unity and economic recovery.

Do we need to flood our country with blood just to realize our misdemeanor in pampering the dogs that eat our flesh? Hope not because the people has suffered too much especially out freedom fighters from the south knowing they have the rights to fight the ancestral land is powerless in the hand of the oppressor, our own government is in cahoots with the worlds aggressor none other than the superpower today.
